One year after a 2022 Supreme Court decision that the Centers for Medicare & Medicaid Services (CMS) did not have the authority to lower reimbursement rates to hospitals participating in the federal 340B Drug Pricing Program, CMS has proposed to pay the hospitals back for years of reduced payments with a one-time $9 billion lump sum in restitution. How will hospitals actually get their share of the funds, and will the plan end up costing them money anyway?
